Will my husband more than likely go to Jail?

My neighbor has been a nuiance for a good while now. We even put up a privacy fence so he would leave us alone.

Yesterday I was making a flower bed in my yard and this nut comes out and starts yelling my name. He then starts calling me a *****, whore, and etc. He then tells me to come out in the road cuz he wanted to wope my @ss. I got scared and called my husband. My husband comes home and this man threatens to shoot him. So my husband turns away and this nut threw a rock and hit my husband. Well my husband beat the hell out of this man. This whole incident from the beginning to where I was planting flowers was witnessed by 3 other neighbors. They went with me and my husband to press charges. While up there this man comes in and fills out a paper to press charges on my husband for beating him up.

What are the chances of my husband or I getting arrested and going to jail because of this crazy nut?

He did try to fight me and then hit my husband with a rock first.

Your husband has a good chance of going for a night or two and maybe having a hefty fine too. It doesn't matter that your husband was hit with a rock first, it is still assault because self defense can not be claimed if you retaliate with more force than is necessary to defend yourself. Your neighbor will face legal action too though. If you and your neighbor mutually agree to drop charges then you will both walk away with no action, but chances are that he won't drop charges if you and your husband are wishing to press charges against him... it is a sad fact of how our legal system works. I can honestly say I would have done the same thing in your husband's shoes, but I'm sorry to bring you this unfortunate reality.
Reply:More than likely nothing will happen other than charges pressed, and fines to be paid.
Reply:As long as the witness tell the story the DA should drop any charges against your husband.



Now if your husband could have escaped after being hit with a rock and could have called the police instead, they may decide to press charges. Most liekly if no past criminal record, it would be a fine and probation.
Reply:Talk to a good lawyer. make sure you have statements from the witnesses and a Police complaint.
Reply:Be sure you have those witnesses strapped to your *** when you go to court. It sounds to me that if you can get them to testify about this guy's crappy demeanor at the time of the incident (throwing the rock, threatening the use of a firearm, etc...), your husband's actions may be justified. I don't think you have much to worry about.
Reply:Girl, he aint going to jail. You are going to need your witnesses....and a record of events....keep your story straight. maybe some fines and some med bills...but press charges too.
Reply:First of all, Whose property where they figthing on? because if he was on your property thats a plus for you. Second of all there is a thing called self defense! If he is a known trouble maker, which is what he sounds like, They will have records. Your husband wont go to jail. He may be charged a fine though!
Reply:The worst that can happen to your hubby is a simple battery charge. Probably would get no jail time.
Reply:If he lives in the great state of Florida, he won't go to jail.

Reply:you are allowed to defend people if there is reasonable fear that the person you are defending would be harmed and may be unable to defend themselves. i've seen some strage things in the justice system and your hubby may be charged, but a good lawyer should get him off. first thing i would do is get a restraining order on your neighbor.
Reply:Have a good lawyer and explain what happened carefully. Don't lie about anything, either. The "crazy nut" will probably be sent to jail for threatening to shoot your husban. Everything wil be fine, don't worry.
Reply:Sure, he could be charged. Both of them could be.



If not, maybe it's time to move the trailer somewheres else.
Reply:You husband might get done for public disorder or something but as the other guy started it (and there were witnesses) your husband is unlikely to go to jail. Just make sure he keeps a low profile and stays calm from now on.
